Nursing Home Negligence / Wrongful Death

A 93-year-old adult entered a long-term care facility for rehabilitation and required significant assistance with mobility. She was known to be at heightened risk for developing pressure injuries and depended on facility staff for repositioning and other essential care.

The lawsuit alleged that appropriate preventive measures were not implemented and that changes in her skin condition were not timely assessed or treated. A pressure injury progressed, became severely infected, and ultimately required hospitalization. She later died from complications associated with her condition.

D’Amico Pettinicchi pursued claims against the healthcare providers and entities responsible for her care. The case required extensive analysis of nursing records, care plans, wound documentation, photographs, and the actions taken as her condition deteriorated. The firm alleged that significant warning signs were missed and that appropriate measures could have prevented the wound from progressing to a life-threatening infection. We ultimately secured a $1.1 million settlement, providing compensation for the pain and suffering she experienced and the losses resulting from her premature death.
